Only the services specifically agreed to in writing are included in the project scope. Additional requests, added features, extra revisions, new pages, new campaigns, added integrations, troubleshooting, or other work outside the agreed scope may require additional fees or a separate agreement.

2. Website Use

You agree to use our website only for lawful purposes. You may not use our website in a way that could damage, disable, overburden, or impair the website or interfere with another person's use of the website.

You agree not to attempt to gain unauthorized access to any part of the website, server, account, system, or network connected to Bonfire AI.

Where we collect phone numbers, including through contact forms, scheduling forms, service inquiry forms, or other request forms, we may include an SMS/text messaging consent checkbox or similar opt-in language. By providing your phone number and giving consent, you agree to receive text messages from Bonfire AI related to your inquiry, appointments, project follow-ups, reminders, support messages, service communications, and occasional marketing updates if you have opted in.

Carriers are not liable for delayed or undelivered messages.

After opting out, you may receive one final confirmation message and no further texts unless you opt back in.

6. Client Responsibilities

If you engage Bonfire AI for services, you agree to:

• Provide accurate project information, instructions, content, and feedback;
• Provide required access to websites, hosting, domains, advertising accounts, analytics tools, social media platforms, or other necessary systems;
• Review and approve work in a timely manner;
• Ensure that any content, images, logos, copy, media, data, or materials you provide are owned by you or properly licensed;
• Comply with applicable laws, advertising policies, platform rules, privacy requirements, and third-party terms;
• Keep your passwords, accounts, and access credentials secure.

Bonfire AI is not responsible for delays, errors, added costs, or performance issues caused by incomplete information, delayed feedback, inaccurate instructions, missing assets, or lack of required access.

7. Client Content and Materials

You retain ownership of the content and materials you provide to Bonfire AI, including text, images, logos, brand assets, media files, business information, and project materials.

By providing content or materials to Bonfire AI, you grant us permission to use, edit, copy, display, modify, and process those materials as needed to provide the agreed services.

You are responsible for ensuring that the materials you provide do not violate any copyright, trademark, privacy right, publicity right, contract, law, or third-party right.

If you upload images or media to a website, you are responsible for checking whether the files contain embedded data, including location data. Visitors may be able to download and extract location data from uploaded media.

8. Comments and User Submissions

If comments or user-submitted content are enabled on our website, you are responsible for the content you submit.

You agree not to submit content that is unlawful, abusive, defamatory, threatening, spam, misleading, infringing, or otherwise inappropriate.

Late or unpaid invoices may result in delayed work, paused services, withheld deliverables, suspension of support, or termination of the project or service.

Payments for completed work, consultation, strategy, planning, third-party costs, and work already performed are generally non-refundable unless otherwise agreed in writing.

12. Revisions and Project Changes

Any included revisions will be based on the agreed project scope, proposal, invoice, or written communication.

Revision requests must relate to the original project direction and agreed scope. Requests that materially change the project, add new deliverables, add new pages, require new concepts, or exceed the included revision scope may require additional fees.

Once a design, page, campaign, content item, website, or deliverable is approved, later changes may be treated as additional work.

13. Timelines and Delays

Bonfire AI will make reasonable efforts to meet agreed timelines. Timelines are estimates unless a fixed deadline is expressly agreed in writing.

Project timelines may be affected by client feedback, approvals, missing content, third-party platforms, technical issues, scope changes, or circumstances outside Bonfire AI's reasonable control.

If a project is delayed because of missing information, delayed communication, lack of access, or pending approval, Bonfire AI may revise the timeline or pause the project until the required items are provided.

14. Third-Party Tools and Services

Bonfire AI may use or recommend third-party tools and platforms such as website hosting providers, domain registrars, WordPress, plugins, scheduling tools, email platforms, analytics tools, social media platforms, advertising platforms, payment processors, or other software and services.

Your use of third-party tools and platforms may be subject to their own terms, policies, fees, and privacy practices.

Bonfire AI is not responsible for third-party downtime, pricing changes, policy changes, account suspensions, data loss, security incidents, plugin conflicts, software updates, or service limitations.

15. Advertising, Marketing, and Campaign Results

For digital marketing, social media, Google Ads, Meta Ads, or related services, Bonfire AI does not guarantee specific sales, leads, revenue, traffic, engagement, follower growth, search rankings, conversions, return on ad spend, or business results.

Marketing and advertising performance depends on many factors outside Bonfire AI's control, including market demand, competition, budget, offer quality, audience behavior, landing page performance, platform algorithms, account history, and third-party platform policies.

The client is responsible for advertising spend unless otherwise agreed in writing.

16. Websites, Development, and Technical Work

For website, development, automation, app, or technical services, you understand that websites and digital tools may behave differently across browsers, devices, hosting environments, plugins, themes, platforms, and third-party integrations.

Unless otherwise agreed in writing, ongoing maintenance, updates, backups, security monitoring, content updates, hosting management, and technical support are not included after launch or delivery.

The client is responsible for maintaining hosting, domains, email accounts, subscriptions, licenses, and third-party services unless Bonfire AI has agreed to manage them as part of an ongoing service.

17. Intellectual Property

You retain ownership of the materials you provide to Bonfire AI.

Upon full payment, you may use the final approved deliverables created specifically for your project, subject to any limits related to third-party assets, software, fonts, stock media, plugins, licenses, or platform terms.

Bonfire AI retains ownership of its pre-existing materials, processes, methods, templates, systems, code libraries, working files, draft concepts, rejected concepts, internal tools, know-how, and reusable design or development structures unless expressly transferred in writing.

Editable source files, raw files, layered files, code repositories, working files, and internal documentation are not included unless specifically agreed in writing.

Until full payment is received, Bonfire AI may withhold final deliverables, source files, website transfer, launch access, or other project materials.

18. Portfolio and Promotional Use

Unless you request otherwise in writing, Bonfire AI may display completed work, project descriptions, screenshots, client names, logos, or case study materials in its portfolio, website, social media, proposals, and promotional materials.

Bonfire AI will not knowingly disclose confidential business information that has not been made public by the client.

19. Privacy

Your use of our website and services is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, protect, and retain personal information, including information submitted through contact forms, scheduling tools, comments, SMS/text messaging, cookies, embedded content, and service-related communications.

20. Disclaimers

You agree to defend, indemnify, and hold harmless Bonfire AI from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Payment is overdue;

• The client becomes unresponsive for an extended period;
• The requested work is unlawful, misleading, abusive, infringing, or unethical;
• Continued work creates legal, security, reputational, or operational risk;
• These Terms are violated.

Upon termination, the client remains responsible for payment for work completed, costs incurred, and approved third-party expenses up to the termination date.

24. Changes to These Terms

Bonfire AI may update these Terms and Conditions from time to time. When changes are made, the "Last Updated" date may be revised.

Your continued use of our website or services after updated Terms are posted means you accept the updated Terms.

25. Governing Terms

These Terms, together with any applicable proposal, invoice, written agreement, project scope, and Privacy Policy, represent the understanding between Bonfire AI and the client regarding use of the website and services.
